'Dreamer' who says he was deported by Trump admin jailed after re-entering U.S.

Nov. 9 (UPI) -- The first person under the Deferred Action for Childhood Arrivals program to say he was deported under President Donald Trump has been arrested for trying to re-enter the United States, authorities said.

Juan Manuel Montes was taken into custody by Border Patrol agents Monday after crossing near Calexico, Calif.

Montes, 23, is being held in the Imperial County Jail and faces a federal felony charge, for which he could get up to two years in prison.

The "Dreamer" -- a name given to immigrants covered under the DACA program -- said he was first deported Feb. 19 and became the the first one removed from the United States under the Trump administration.

Customs and Border Patrol, though, has said it has no record of Montes' deportation in February.

Attorneys for Montes tried to sue the Trump administration to bring him back to the United States and a judge in San Diego was prepared to hold a trial to clarify the situation. However, the suit was ultimately dropped and Montes lived with his family in Mexico for eight months.

Former President Barack Obama granted "Dreamer" protection under the DACA program to more than 800,000 undocumented immigrants who were brought to the United States as children.

This summer, Trump said he would end the program, but has given Congress six months to pass a bill to protect those under DACA.
