New York police took Rojas, who a law enforcement official said appeared to have been either drunk or on drugs, into custody, The New York Times reported.

Rojas has been arrested twice in New York for drunken driving, New York Police Commissioner James O'Neill said.

The incident occurred on 45th Street and Broadway at about noon.

"FDNY confirms 1 fatality, 12 injuries in Times Square motor vehicle accident," FDNY said in a statement.
