CINCINNATI, Dec. 12 (UPI) -- The retrial of former University of Cincinnati police officer Ray Tensing for the shooting death of a motorist will begin in late May, a judge decided Monday.
Hamilton County Common Pleas Judge Leslie Ghiz said at a hearing Monday that the trial will begin May 25 in the same southern Ohio county.
Tensing was tried on murder and voluntary manslaughter charges last month but the case ended with a deadlocked jury. Prosecutor Joe Deters decided to retry the case but said he will try to get it moved to another county, out of concern for a potentially biased jury pool in Hamilton County.
However, Deters has not yet filed a formal request to have the retrial moved.
Tensing is charged in the July 2015 shooting death of motorist Sam DuBose, who was stopped by Tensing near the Cincinnati campus. After being asked to provide his driver's license, DuBose appeared to try and drive away and was shot by Tensing. The incident was captured on Tensing's body camera.
DuBose, 43, was not armed.
Tensing, 27, testified at the first trial that he feared for his safety, but prosecutors say the UC patrolman used excessive deadly force.
