PARSONS, Tenn., May 28 (UPI) -- A 29-year-old man who was promised immunity in exchange for helping authorities crack the case of missing nursing student Holly Bobo will present arguments in his suit against the prosecution in a circuit court Wednesday.
Shayne Austin sued the state of Tennessee after the prosecution tried to revoke the immunity offer extended to him. The state attempted to have the lawsuit dismissed on the basis that it was filed in the wrong court, and that it would reveal unnecessary information about the Bobo case.
Decatur County Chancellor Carma D. McGee ruled Tuesday, however, that a circuit court should hear Austin's arguments the following day.
Austin's attorney, Luke Evans, said during Tuesday's hearing that his client had testified against the other suspects in exchange for immunity and that he later received an email from the district attorney stating that the deal was off.
The DA claims Austin violated the terms of their agreement when he lied about what happened the day 20-year-old Bobo disappeared from her Decatur County, Tenn., home.
News of the state's decision to revoke immunity came on the same day that the prosecution announced the indictment of a second man, Jason Wayne Autry, 39, in the 2011 disappearance of Bobo.
Zachary Adams was charged with first-degree murder and aggravated kidnapping in the case in March. Autry will also appear in court Wednesday.
