LEXINGTON, Tenn., April 30 (UPI) -- A man who was granted immunity in the case of missing Tennessee nursing student Holly Bobo may become the third person charged with her murder.

The Jackson Sun obtained documents that show prosecutors have voided their immunity agreement with Shayne Kyle Austin. These include a March 27 email from Assistant District Attorney General Beth Boswell to Austin's lawyer saying he can expect a "courtesy call" when Austin is indicted.

After Bobo, 20, vanished in April 2011, a witness reported seeing her led into a wooded area by a man wearing camouflage. Zachary Adams, 29, was indicted in March on charges of kidnapping and murder, and Jason Wayne Autry, 39, on the same charges Tuesday.

Austin's lawyer filed a motion for a restraining order April 1 that sought to hold prosecutors to the immunity agreement. Boswell's email was included in the filing.

“In exchange for the total cooperation of Shayne Kyle Austin, the State agrees to grant him immunity for all charges arising out of the disposal, destruction, burial and/or concealment of Holly Bobo’s deceased body, conditioned upon him assisting us in recovering the body of Holly Bobo,” the immunity agreement said.

Witnesses have said they saw Autry and Adams with Bobo the day she disappeared, Mark Gwyn, head of the Tennessee Bureau of Investigation, said Tuesday at a news conference. Autry is currently serving a three-year prison sentence on an unrelated charge.

Both Autry and Adams are from Holladay, a rural community in western Tennessee. Bobo was from Darden, another small town in the region.
