Third psychiatric workup done for man, 90, charged with killing wife

ELYRIA, Ohio, Feb. 25 (UPI) -- A new evaluation has found that a 90-year-old Ohio man was mentally competent when he allegedly killed his wife more than five years ago, court records say.

Robert Shaw is scheduled to stand trial in June on aggravated murder and other charges, the (Lorain) Morning Journal reported.

Virginia Shaw died on Nov. 12, 2008, in the couple's Avon home. According to court records, Shaw called 911 and said he had "suffocated" his wife "to put her out of her misery."

"She had been in and out of the hospital and came home a couple of months ago, and ... uh ... I can't talk," he told a 911 operator.

Lorain County court records say Shaw has been through three psychiatric evaluations. Common Pleas Judge Mark Betleski is expected to rule this week on whether the latest evaluation results can be used at his trial.
