SAN ANTONIO, Feb. 12 (UPI) -- A San Antonio judge issued no decision Wednesday in a request to forbid Texas from enforcing its same-sex marriage ban.
The two-hour hearing before U.S. District Judge Orlando Garcia sought a request for a preliminary injunction by two gay couples who sued the state in October. The case is regarded as a potential watershed moment in the history of marriage equality, the San Antonio Express-News reported Wednesday.
Plaintiffs Nicole Dimetman and her spouse Cleo DeLeon, and Vic Holmes and his life partner Mark Phariss, contend the state's 2005 ban is unconstitutional and treats same-sex marriage partners unequally.
Their suit is among over 40 challenging same-sex bans in more than 20 states, including some where federal courts have ruled similar bans are unconstitutional. Two other suits are pending in Texas.
Garcia was expected to take Wednesday's arguments "under advisement" and offer a ruling later. He offered no timetable for his decision, the newspaper said.
