Milke, released from death row, gets 2015 retrial

PHOENIX, Sept. 23 (UPI) -- A Phoenix judge set a 2015 retrial date Monday for Debra Milke, released from death row after an appeals court threw out her murder conviction.

Milke, 49, was convicted in 1990 for having two men take her 4-year-old son into the Arizona desert and shoot him to death.

The 9th Circuit Court of Appeals overturned her conviction in March, citing the prosecution's failure to turn over evidence that deprived her defense attorneys the opportunity to question former Phoenix detective Armando Saldate, who alleged Milke confessed the crime to him in a private interrogation room, KPHO-TV, Phoenix, said.

Milke was released Sept. 6 on $250,000 bond and will remain free on bond as she awaits trial, KNXV-TV, Phoenix, reported.
