Man sues McDonald's over genital burns from unsecured coffee cup lid

HACKENSACK, N.J., July 2 (UPI) -- A Florida man is suing McDonald's in New Jersey, claiming an unsecured coffee cup lid led to him suffering second-degree burns to his genitals.

Francisco Rafael Borbolla, 54, of Homestead, Fla., said in the suit, filed Monday in Superior Court in Hackensack, N.J., that restaurant workers gave him a cup of coffee without properly securing the lid when he ordered breakfast in a River Edge, N.J., McDonald's in 2011.

Rosemary Arnold, Borbolla's attorney, said the hot coffee spilled on his crotch as he sat down at a table, causing burns that required a trip to Hackensack University Medical Center's emergency room.

She said Borbolla was in New Jersey to visit his family.

The suit seeks an unspecified amount in compensatory and punitive damages, The (Hackensack) Record reported Tuesday.

Arnold insisted her client's lawsuit is not frivolous.

"This is a serious case involving lack of due care on the part of McDonald's," she said. "If the naysayers saw the burns on my client's genitals they would be speechless."
