Woman sues after 25-pound candy dispenser falls on her

NEW YORK, July 1 (UPI) -- A Pennsylvania woman has filed a lawsuit against a company that makes candy dispensers after a 25-pound candy dispenser fell on her in New York City.

The incident happened on Oct. 26, 2008, inside the flagship Toys R Us store in New York City's Time Square, the New York Daily News reported.

The lawsuit alleges that while Beth Flickinger, 42, who was visiting New York City with her husband and their two sons, was trying to fill a bag with light blue M&Ms, the entire dispenser fell, hitting her forehead and twisting her neck.

"My vision went black for a couple of seconds," Flickinger testified in the case heard last week in Brooklyn federal court. "All I'm thinking is, [I've] got to catch this thing so it doesn't land on the kids. I remember myself and my boys screaming for help."

Flickinger said she suffered excruciating headaches, a herniated disk, loss of income and a diminished sex life after the incident.

The lawsuit alleged Trade Fixtures, the maker of the candy dispenser, should be held responsible because the dispenser was not properly secured due to a design defect.

Trade Fixtures lawyer James Burke said that there has never been a similar report with any of the company's 50,000 dispensers nationwide.

Flickinger is seeking an unspecified amount of money in damages.
