Astor's son too old to go to prison, lawyers tell judge

NEW YORK, June 18 (UPI) -- Lawyers for the son of the late New York society matron Brooke Astor say their client is too old to serve time for stealing millions of dollars from his mother.

The argument was made in a motion heard in a Manhattan court only days before Anthony D. Marshall, 89, and Astor family attorney Francis X. Morrissey, Jr. are due to report to serve their sentences, The New York Times reported Monday.

Marshall is too frail to go to prison, defense attorneys argued. On Friday, Marshall's attorneys had filed a motion reiterating allegations that a juror had felt threatened into voting to convict Marshall and Morrissey during their 2009 trial.

Both motions seek new hearings to determine if Marshall's conviction should be overturned.

Assistant District Attorney Elizabeth Levy argued the motions were "frankly disingenuous" because they restated arguments already rejected by the court.

Marshall and Morrissey had been scheduled to report to prison Monday to begin serving their sentences of one to three years.

Marshall had received a short reprieve because corrections officials said they needed a few days to review his hundreds of pages of medical records.

Both men could be taken into custody Thursday when they are due back in court.
