BOSTON, May 21 (UPI) -- Lawyers for Boston Marathon bombing suspect Dzhokhar Tsarnaev can have records of his incarceration at a prison hospital, a federal magistrate ruled.
But U.S. Magistrate Judge Marianne B. Bowler rejected a defense request to have the U.S. Bureau of Prisons keep that same information out of the hands of prosecutors absent a court order or defense consent, The Boston Globe reported Tuesday.
The request for information on Tsarnaev's daily activity, suicide watch logs, psychology data files and any other records related to his incarceration was sought in a secret filing with the court.
Bowler made the request public Monday after issuing her ruling.
Tsarnaev, 19, is being held at a federal prison medical facility in Fort Devens, Mass. He faces charges of using a weapon of mass destruction and malicious destruction of property resulting in death.
His brother Tamerlan Tsarnaev, 26, another suspect in the April 15 bombings, was killed April 19 when he was shot by police and run over by his younger brother.
