Hockey mom sex case ends in 2nd mistrial

SANTA ANA, Calif., March 29 (UPI) -- A California hockey mom convicted of having sex with a 16-year-old boy has had a second mistrial declared on charges she sexually assaulted a 13-year-old boy.

Orange County Superior Court Judge W. Michael Hayes called the mistrial Thursday after a jury deadlocked 10-2 in the retrial of Kathia Maria Davis, 45, of Laguna Niguel, who was charged with having sex with the 13-year-old friend of her son, The Orange County Register reported.

Davis' first trial last August on four felonies involving the 13-year-old also ended in a mistrial, KTLA-TV, Los Angeles, reported. She was convicted, however, of having sex with the 16-year-old.

Prosecutors in the second trial said Davis gave alcohol to the two teenagers associated with the Beach City Lightning hockey club, then engaged them in sexual acts.

Davis' attorney said she rebuffed advances of the 13-year-old, and thought the other boy was 18, the same age as her son, when she had consensual sex with him.

The investigation began when the 16-year-old informed his mother, who contacted police, Orange County Sheriff's Office spokesman Jim Amormino said.

"We received complaints that she was throwing parties for members of the hockey team, and other friends of her son, and providing them with alcohol," Amormino said.

Deputy District Attorney Jennifer Walker said, after the second mistrial, it had not been decided whether prosecutors would pursue a third trial.
