Judge Robert Devlin Jr. set a March 5 hearing on probable cause, when prosecutors are to present evidence to support charging Smith with murder.

Public Defender Joseph Bruckmann, who stood beside Smith, declined comment.

Nicole Rabb, Smith's cousin, had told police Smith, who grew up in Ansonia, Conn., but lived in Florida, was staying with her when he admitted he had a taste for blood after eating a rare steak. He left her apartment with a small ax and returned with blood on his clothes and the ax Dec. 15, police said.

Police discovered Gonzalez's decomposed body Jan. 23 missing portions of his brain and skull and an eyeball. Rabb told police Smith confessed to eating the eyeball and part of the brain.
