Ariz. governor's lawsuit thrown out

PHOENIX, Jan. 5 (UPI) -- A U.S. District Court judge threw out an unusual suit by Arizona Gov. Jan Brewer asking to clarify the state's recent medical marijuana law, officials say.

The lawsuit asked the court to clarify whether federal laws supersede Proposition 203, which passed in 2010. The law allows people with certain medical conditions to receive special state IDs, which can be used to procure medicinal marijuana. It also allows the state Department of Health to issue permits for a limited number of marijuana dispensaries.

Brewer filed the suit in May, days before the permits could begin to be issued. She asked the court whether state workers were in danger of federal prosecution if they were to implement the proposition, The Arizona Republic reports.

Judge Alison Bolton wrote in her ruling: "Plaintiffs do not challenge any specific action taken by any defendant. Plaintiffs also do not describe any actions by state employees that were in violation of (the federal Controlled Substances Act) or any threat of prosecution for any reason by federal officials. These issues, as presented, are not suitable for judicial review."
