PROVIDENCE, R.I., Nov. 14 (UPI) -- A Rhode Island Superior Court judge Monday turned down a request for a new trial for a mother convicted of murdering her 8-year-old daughter.
Judge William E. Carnes Jr. refused the retrial motion for Kimberly Fry, the North Kingstown mother found guilty of the 2009 second-degree strangulation murder of her daughter, Camden, WPRI-TV, Providence, reported.

Fry's defense team argued during a Thursday hearing the jury should have been presented with the option of considering a manslaughter conviction based on Fry's alleged diminished capacity.
The judge ruled Monday not enough evidence of diminished capacity existed and set Feb. 17 as Fry's sentencing date.
