Molester to testify against attackers

SAN JOSE, Calif., Oct. 18 (UPI) -- A California man said he will testify against two men accused of beating him after he admitted molesting the stepdaughter of one of the alleged attackers.

Avelino Rodriquez, of San Jose, said Monday he would take the stand against brothers Erik and Miguel Cerda, who allegedly whipped and punched him and burned him with a cigarette, the San Jose Mercury News reported Tuesday.

Rodriguez was sentenced to 22 years in prison this month for duct-taping an 8-year-old girl's mouth and sexually molesting her in November 2010. Miguel Cerda says he considers himself a stepfather to the girl -- he is the long-term boyfriend of the girl's mother with whom he has two children.

The brothers have turned down plea deals that would have carried a four-year prison term instead of seven years to life for charges of torture, mayhem, battery, assault and making criminal threats. The two could face terms longer than Rodriguez's 22 years.
