MIAMI, Sept. 14 (UPI) -- A Florida man sentenced to death for the fatal shooting of a police officer has been given a third execution date, this one for Sept. 28.
Gov. Rick Scott initially signed a warrant calling for Manuel Valle to die by lethal injection on Aug. 2 but the Florida Supreme Court ordered a temporary delay, The Miami Herald reported Wednesday.
The delay allowed the court to hold a hearing on one of the drugs used for lethal injections.
Once the court allowed the execution to go forward, Scott set a new date of Sept. 6.
Another temporary stay was issued, this time by a federal appeals court in Atlanta that wanted to examine Valle's claim that he should have received a clemency hearing.
The court ruled against Valle and lifted the stay.
Valle was convicted of fatally shooting Louis Pena, a Coral Gables police officer, in 1978.
He still has a case pending in federal court and a petition before the U.S. Supreme Court.
