Gizmodo cleared, 2 charged in iPhone sale

REDWOOD CITY, Calif., Aug. 10 (UPI) -- The San Mateo County, Calif., district attorney Wednesday filed misdemeanor charges against two men accused of selling a lost iPhone 4 prototype in 2010.

However, no one at Gizmodo, the Web site that bought the prototype before it was released by Apple, will be charged, Ars Technica reported.

The district attorney said Brian Hogan, 22, who allegedly found the lost iPhone 4 in a Silicon Valley bar, and his friend, Sage Wallower, 28, were charged with misappropriation of lost property.

In the spring of 2010 Gizmodo rocked the tech world when it published photos of the future iPhone. After a protracted legal battle, Gizmodo eventually gave the device back to Apple.
