Court: Lesbian partner has no child right

COLUMBUS, Ohio, July 12 (UPI) -- A woman who shared parenting with her lesbian partner has no parental rights now that the relationship is over, the Ohio Supreme Court said Tuesday.

The court's 4-3 ruled in favor of the biological mother, Kelly Mullen of Cincinnati, The Columbus Dispatch reported. It upheld lower court decisions.

"The juvenile court also stated that although the evidence was unclear whether a shared custody agreement was actually drafted by the parties or presented to Mullen, the evidence did show that Mullen consistently refused to enter into or sign any formal shared custody agreement when presented with the opportunity to do so," the majority opinion said.

The minority said Mullen agreed before her daughter, Lucy, was born that her partner, Michele Hobbs, was a co-parent. The justices said Mullen only reneged on that decision after the couple broke up.
