11-year-old boy charged with murder

INDIANAPOLIS, July 3 (UPI) -- An 11-year-old Martinsville, Ind., boy has been charged with killing his 6-year-old brother, authorities say.

The older boy allegedly shot his brother, Andrew Frye, in the head with a .22-caliber gun Thursday afternoon in their home, ABC News reported. The older brother is being charged as a juvenile with murder and criminal recklessness, making him the youngest person to be charged with murder in Indiana in 90 years.

The police received the 911 call from the 11-year-old at 6:15 p.m. When they arrived on the scene, Andrew had a gunshot wound to his head and was rushed to Riley Hospital for Children in Indianapolis, where he died less than 2 hours later.

Initially, the shooting was thought to be an accident but the investigation led to the decision to bring charges, Morgan County prosecutor Steve Sonnega told ABC.

"There are cases where what you first believe to be true isn't necessarily where the evidence takes you," Sonnega said.

The police said they also would be looking into possible neglect of the boys by their mother and her boyfriend, who cared for them.

"Obviously this is a very tragic time for them. We'll address that issue down the road," Sonnega said.
