NEW YORK, June 29 (UPI) -- An appeals court has revived a criminal case against a New York City school bus aide who allegedly allowed an autistic boy to beat his head against a window.
Connie Clark, 53, was arrested almost six years ago and charged with child endangerment. The charges were dismissed twice by lower courts, only to be reinstated twice when prosecutors appealed, the New York Post said.
"We can't believe it," her lawyer, Peter Tilem, said. "This is the first case that I've ever seen where we get it dismissed twice, and the appellate division reverses."
The case was dismissed the second time because prosecutors mailed a notification they were ready for trial to a previous address for Tilem's firm. The appeals court decided the mistake was an innocent one.
Clark allegedly made fun of the boy while he was beating his head. He is now 13.
"After all this time, my family is pleased that we may see some justice for P.J.," the boy's father, Paul Rossi, told the Post.
