Lawyers: Smart suffered no long-term harm

SALT LAKE CITY, May 17 (UPI) -- Elizabeth Smart's father is angry lawyers plan to use her recovery to seek a shorter sentence for the man who kidnapped her from her Salt Lake City home.

Ed Smart said Monday it is an "outrage" Brian David Mitchell's attorneys argue his then-teenage daughter was not "psychologically affected" by being abducted and held for months as Mitchell's second wife.

"She has moved beyond it, but it certainly impacted her at the time," Smart said.

Mitchell, 57, is to be sentenced May 25 in federal court in Salt Lake City. His wife Wanda Barzee was sentenced to 15 years in 2009.

Elizabeth Smart was 14 when she was kidnapped in 2002. She was held for nine months.

Mitchell faces a possible life sentence. His lawyers submitted a brief Monday arguing against using "extreme psychological injury" as an aggravating factor, saying her testimony in court showed otherwise.

Smart is expected to speak at the sentencing.
