MIAMI, Oct. 13 (UPI) -- Florida's child welfare agency says it won't appeal a court ruling tossing out the state's 33-year-old law banning gay adoptions.
Secretary George Sheldon of the Department of Children & Families said it's clear the decision by the Florida District Court of Appeals "is of statewide application" and will be binding on all trial courts across the Florida.
The ruling came in a case involving two foster children adopted by Frank Martin Gill, an openly gay North Miami man, the Miami Herald reported Wednesday.
Gill "has invested a lot in these children, and clearly loves the children," Sheldon said, adding that Gill has been put though too much uncertainty already.
As of last week, the state had exhausted the allotted time to challenge the adoptions.
Sheldon said he discussed the case with Florida Attorney Gen. Bill McCollum Tuesday and does not know whether McCollum will exercise his authority to appeal the matter to the Florida Supreme Court.
