Dad, stepmom charged with neglect of boy

MIAMI, Aug. 17 (UPI) -- A Miami man who pleaded no contest to manslaughter in the bathtub drowning of a baby son has been charged with neglecting the baby's older brother, police said.

Roberto Fortin's wife, Yoselin Aguirre, 31, is also charged, The Miami Herald reported. She is the boy's stepmother. Both were arrested Monday.

Police said Fortin took his son to Miami Children's Hospital Sunday, saying there were problems with his breathing. Doctors said the child had obviously been seriously ill for some time, that at 40 pounds he was 30 pounds underweight for his age, with skin that had come off in spots.

Fortin, 30, said the boy was autistic and also suffers from ADHD. Court documents did not give his age, but WFOR-TV, Miami, reported he is 7 years old.

Fortin received probation in 2006 after he entered a no contest plea to a manslaughter charge. He said he fell asleep when he left his 9-month-old son in the bathtub with the water running, and found the baby unconscious when he woke up.
