BUFFALO, N.Y., July 19 (UPI) -- A New York judge Monday ruled that the so-called "HIV Predator" could remain locked up even though his prison sentence has been served in full.
Nushawn Williams completed his 12-year stretch in April; however the state has thus far refused to release him on the grounds he is a threat to society.
A New York Supreme Court judge in Buffalo Monday dismissed Williams' petition for release and ruled he could remain in jail while awaiting an October trial under the Civil Confinement Law, WKBW-TV in Buffalo reported.
Williams infected at least 13 women in the Buffalo area with the HIV virus and served separate sentences for rape and reckless endangerment. While in prison for reckless endangerment, the 2007 Civil Confinement Law was passed, allowing individuals to be imprisoned indefinitely if they are determined to pose a threat to society.
Williams argued the law was passed while he was already in prison and he should not be subject to it.
