Judge refuses to dismiss Lidle death suit

NEW YORK, July 7 (UPI) -- A judge in New York refused to dismiss a suit brought by the widow of Yankees pitcher Cory Lidle against the maker of the airplane he crashed into a building.

U.S. District Judge Barbara Jones ruled Tuesday a jury should decide whether problems with the small plane's control system were to blame for the crash, the New York Post reported.

Lidle and Tyler Stanger, a flight instructor, flew the plane made by Cirrus Design Corp. up the East River and then attempted to execute a turn to head south again. The East River is a dead end for general aviation with restricted air space on both sides and as the river narrows to the north.

Both men were killed when the plane hit an apartment building on Manhattan's Upper East Side.

Jones said Melanie Lidle presented enough evidence from experts she had hired to create questions of material fact, the judge ruled.
