ST. GEORGE, Utah, Dec. 28 (UPI) -- A vice principal and teacher at a school in St. George, Utah, say legal claims against them stemming from the prop gun death of a student should be dismissed.
Deseret Hills High School Vice Principal Robert Goulding and Deseret Hills theater teacher Michael Eaton say they are protected from being sued for alleged negligence under the Utah Governmental Immunity Act, The Salt Lake Tribune said Monday. The two educators allege only their employer can be cited.
The pair work for the Washington County School District.
Goulding and Eaton are being sued by the parents of Tucker Thayer, 15, who died in advance of a school theater production Nov. 15, 2008, when a prop pistol loaded with blanks fired.
Parents Ron and Cathie Thayer allege in their suit only adults should have been handling the .38-caliber revolver and a safety plan for the firearm was repeatedly violated prior to their son's death.
