DETROIT, Dec. 23 (UPI) -- A prosecutor in Wayne County, Mich., said he is planning on appealing a judge's ruling a teenager will get a new trial for the killing of a friend.
Wayne County Prosecutor Kym Worthy said she will appeal Circuit Judge Bruce U. Morrow's decision regarding Jean Pierre Orlewicz, 19, to the Michigan Court of Appeals, The Detroit News said Wednesday.
Morrow ruled Tuesday Orlewicz should receive a new trial because psychiatric testimony regarding the teen's past was left out of his 2008 trial.
"This denial deprived defendant Orlewicz of his right for a fair trial," Morrow said in his decision.
Orlewicz was convicted and sentenced to life in prison without the possibility of parole for the November 2007 slaying of his friend, Daniel Sorensen.
Authorities allege Orlewicz prepared a death trap for Sorensen, 26, at a garage in Canton Township, Mich. As part of the ambush, Orlewicz allegedly stabbed Sorensen, before burning and beheading the body to make identification of the remains difficult.
"We are baffled by the judge's decision and believe that it is based upon a profound misunderstanding of the Sixth Amendment, the rules of evidence and the rules of criminal procedure," Worthy said in a statement.
