Dallas lawsuit filed over smoking neighbor

DALLAS, Sept. 30 (UPI) -- A Dallas woman is suing over an alleged construction defect in her former townhome that she claims caused unit to fill up with her neighbor's cigarette smoke.

Chris Daniels is seeking damages from her former neighbor and landlord over alleged damages to her belongings and to her and her daughter's health.

The Dallas Morning News said Wednesday the suit comes after a long battle in which the Daniels' neighbor, Rebecca Williams, refused to refrain from smoking and the management of the building tried unsuccessfully to block the fumes.

Daniels, a retired nurse, and her daughter claimed in court they suffered from constant breathing difficulties and burning eyes. In addition, they contend, their clothes and furniture reek of smoke.

The case is being closely watched by the Dallas apartment industry, the newspaper said, because people who have sensitivity to smoke generally avoid buildings where smoking is allowed.

The attorneys for the building argued in court that there is a solid firewall between Daniels' and Williams' units and the Daniels renewed their lease six months after Williams moved in.
