Suit: Waitress fired for refusing dress

LONDON, Dec. 19 (UPI) -- A Muslim woman's lawsuit against a London restaurant claims she was fired for refusing to wear a dress that suggested she was "sexually available."

Fata Lemes, 33, said in her lawsuit that the "indecent" form-fitting red cocktail dress she was forced to wear by the Rocket bar made her look "like a sex club hostess" and caused patrons to proposition her for sex, The Guardian reported Friday.

"If you put this dress on, you might as well be naked. Everything finishes in the middle at the chest. It is open at the front and back. I did not want men looking at my body," Lemes told a London employment tribunal.

She said she was fired for refusing to wear the dress.

"I was brought up a Muslim, and am not used to wearing sexually attractive clothes," she told the tribunal.

The company that owns the restaurant, Spring and Green, said Lemes was not fired, but rather resigned by choice. The company said the dress is a "summery staff uniform" that was chosen by two other waitresses at the establishment.

A ruling on the case is expected in early 2009, The Guardian said.
