Ohio lawsuit challenges Obama's legitimacy

LEBANON, Ohio, Oct. 26 (UPI) -- An Ohio man is suing to find out whether Democratic presidential nominee Barack Obama was born in Hawaii or in his father's native Kenya.

David Neal of Turtlecreek Township, Ohio, filed his lawsuit Friday in Warren Common Pleas Court, The Cincinnati Enquirer reported Sunday.

Neal is seeking to have state and federal officials settle questions over Obama's ability to be president since the U.S. Constitution requires presidents to be, among other criteria, natural-born citizens.

"Mr. Obama has failed to demonstrate that he is a 'natural-born' citizen," Neal said.

The newspaper reported that much of the wording in Neal's suit mirrors language in a similar challenge filed by Pennsylvania attorney Philip Berg. That lawsuit was rejected Friday by U.S. District Judge Richard Barclay Surrick of the Eastern District of Pennsylvania, Legal Newsline reported Sunday.

The legal Web site reported Berg said he intends to appeal to the U.S. Supreme Court.
