TORONTO, June 19 (UPI) -- A Toronto man who "went too far" in a road-rage dispute in 2006 was sentenced to 10 years in prison for manslaughter.
Marvin Green, 30, was sentenced for the shooting death of Dennis Oppong, 28, around 3 a.m., Dec. 3, 2006, the Toronto Star reported.
The men got into an exchange near the entertainment district and both stopped their cars and began fighting, court heard. Oppong stood 6-foot-2 and weighed 242 pounds, while Green is 5-foot-4 and weighs 150 pounds.
Green broke away long enough to get a gun from his car and fired five shots, prosecutors said. One hit Oppong in the abdomen and a second hit the top of his head. He was declared dead soon afterward at a hospital.
Green's defense attorney, John Struthers, told the sentencing judge the shooting was based on self defense but went sour.
"This was a case of excessive force," Struthers said. "The reason it's not murder is because he initially was defending himself but he went too far."
