Gary, Ind., police sued over crash

GARY, Ind., Oct. 16 (UPI) -- The body an 18-year-old Gary, Ind., man may be exhumed in his family's quest to prove he was alive when police failed to find him after a car crash.

Dominque Green's family said his body was swollen and bruised, indicating he was alive after being thrown from the car Sept. 15 with Brandon Smith, 18, the Greens' lawyer, Kenneth J. Allen, told the Northwest Indiana Times.

The Greens have filed a $50 million lawsuit against the city of Gary and its police department for failing to find Green and Smith, even though the driver of the single-car crash, Darius Moore, 17, said he pleaded with police to look for his friends, the Times reported Tuesday.

After police left the scene, Green and Smith's bodies were found by family members.

"There is no excuse for what the officers did not do at the scene of this crash," Allen said. "It shocks the conscience and can't be tolerated."

Gary authorities contend Green and Smith died instantly.
