Third player indicted in Duke rape case

RALEIGH, N.C., May 15 (UPI) -- A grand jury in Durham, N.C., Monday indicted a third suspect in an alleged rape of a black stripper at a Duke University sports party.

Dave Forker Evans, 23, the lacrosse team co-captain, lived in the off-campus house where a 27-year-old North Carolina Central University student moonlighting as an exotic dancer claimed she was sexually assaulted at a March 13 party.

Two other Duke lacrosse players were arrested in April on first-degree rape, sex offense and kidnapping charges, the same charges returned against Evans, The New York Times reported.

Evans, son of a Washington lawyer and lobbyist, surrendered to authorities at the Durham County Detention Facility after appearing with his lawyer to declare his innocence.

Evans made a statement to the media, saying he and his teammates were innocent of all charges.

The Raleigh News & Observer reports the woman said she was raped by three men and District Attorney Mike Nifong asked the jury to bring charges against a third person.

The attorneys for 20-year-old Reade William Seligmann and 19-year-old Collin Finnerty say they are innocent.

Seligmann is to be in court Thursday. Finnerty is scheduled to appear in court in June.
