Court: No 'dollars for days' tradeoff

OTTAWA, Nov. 10 (UPI) -- The Supreme Court of Canada has ruled that there is no exchange of "dollars for days" in child support.

The court reversed a lower court's ruling that Joseph Contino could pay less support because his son now spends about half his time with him, the Canadian Broadcasting Corp. reported.

The high court found that many child care costs are fixed and do not depend on how much time a child actually spends in the household. The court found that the relative financial positions of the parents should be the major factor.

The Supreme Court granted Contino some reduction in support from the amount set in the original divorce decree but increased the amount considerably from that set by the Ontario Court of Appeal.

"Today's decision stops the battle of 'dollars for days'," Dedre Smith, lawyer for Joanne Leonelli-Contino, said in a news release. "Now if Dad wants increased time with his children, Mom can't refuse, claiming that he just wants to reduce his support."
