Brownback, Graham: Release Miers' papers

WASHINGTON, Oct. 19 (UPI) -- Sens. Lindsey Graham, R-S.C., and Sam Brownback, R.-Kan., called for release of documents when Supreme Court nominee Harriet Miers was White House counsel.

The Senate Judiciary Committee members broke with GOP colleagues who say executive privilege must not be pushed -- an effort Vice President Cheney has spearhead for five years to strengthen presidential prerogatives, The Hill reported Wednesday.

White House staff said Tuesday documentation about Miers' legal thinking in action would be provided.

While the call by Graham and Brownback will give Democrats more leverage, it is aimed at conservative Republicans withholding support for the Supreme Court nominee, the newspaper reported.

Brownback said he would like to see Miers' policy documents -- not legal documents -- from her term as White House counsel.

"Where there's a close call, the tie goes toward disclosure," Graham said.
