DETROIT, May 5 (UPI) -- Lawyers in Michigan are looking to prosecute the brother of convicted Oklahoma City bomber Terry Nichols for his admitted failure to pay federal income taxes.
James Nichols, a soybean farmer from Decker, Mich., is suing Michael Moore, alleging the documentary filmmaker tricked him into appearing in his movie, "Bowling for Columbine." Nichols told Moore's lawyers during a deposition that he was not required to file federal income taxes, and Moore lawyer Herschel Fink has filed a motion to have the U.S. attorney's office made aware of the "admitted, continuing tax evasion."
Relations between Nichols and Moore have been strained. Moore has stated he thought James Nichols was involved in his brother's plot to blow up the Murrah federal building in Oklahoma City.
In 2003 Nichols sued the filmmaker for libel, defamation of character, invasion of privacy and infliction of emotional distress, seeking more than $100 million. A judge threw out some of the suit, but the two are due in court for a hearing on June 2.
