ATLANTA, March 17 (UPI) -- The 11th Circuit Court of Appeals in Atlanta has upheld a Miami deportation order for a man accused of being a spy for Cuba.
The order to deport Juan Emilio Aboy was issued in 2002 and he lost a final bid to remain in Miami three weeks ago, The Miami Herald reported Thursday.
He was arrested in 2002 by agents who said he was a covert agent for the Fidel Castro regime and has been in a federal detention center west of Miami since then.
No charges were filed, but a judge ruled he entered the United State illegally because he did not reveal he as a trained spy and a member of the Communist Party.
Aboy has been on a hunger strike since last weekend and placed under observation in a health unit.
Spokeswoman Barbara Gonzalez said the Immigration and Customs Enforcement Agency has not made a final decision on the disposition of the case.
