Lawyer calls for new trial for Peterson

REDWOOD CITY, Calif., March 15 (UPI) -- Papers filed by Scott Peterson's attorney cite 13 reasons the California man should get a new trial in the murders of wife and unborn son.

Among the charges contained in a 135-page filing made public Monday, attorney Mark Geragos said prosecutors failed to turn over information of a taped phone conversation between a state prison inmate and his brother, the San Francisco Chronicle reported Tuesday.

Four weeks after the pregnant Laci Peterson disappeared, the inmate told his brother Laci Peterson confronted his friend as he was robbing her neighbor's house Dec. 24, 2002 -- after Scott Peterson had left for his fishing trip, the court documents said.

However, Prosecutor David Harris wrote the "new evidence" was not new and had been turned over to the defense team in May 2003.

Judge Alfred Delucchi is scheduled Wednesday to hear oral arguments and rule on whether to grant a new trial for Peterson, who was convicted of double-murder.
