FORT LAUDERDALE, Fla., Nov. 25 (UPI) -- The youngest child sentenced to life in prison in the United States is now in a custody dispute in Fort Lauderdale, Fla., the Miami Herald reported.
The family that took in Lionel Tate a few weeks ago after he was found breaking conditions of his parole, now wants him to leave because they say the frequent visits by probation officers are too stressful.
His attorney, Richard Rosenbaum, wants him to move in with a family friend, while his state-appointed guardian, Howard Greitzer, said he will recommend Tate move back with his mother. Greitzer said he cannot envision Tate, who'll be 18 in January, living on his own any time soon.
During a hearing on his probation violation last month, acting Broward Circuit Judge Joel Lazarus agreed to let Tate leave his mother's home.
Tate was convicted of killing his 6-year-old playmate when he was 12 years old. He was paroled in January on the conditions he remain at home except for school, work or church, unless he has permission from his probation officer.
A hearing on his future home is scheduled for Monday.
