Pennsylvania court throws Nader off ballot

HARRISBURG, Pa., Oct. 13 (UPI) -- A Pennsylvania court Wednesday threw independent presidential candidate Ralph Nader off the state's ballot -- in the second such setback for his supporters.

Moments later Nader's state coordinator vowed to appeal the Commonwealth Court's ruling, KYW-AM, Philadelphia, reported.

Meanwhile, the U.S. Justice Department is suing Pennsylvania to allow an extra two weeks for overseas ballots to be counted -- saying they were not mailed out in time because of the Nader situation.

The court reviewed the matter after lawyers supportive of Democratic candidate John Kerry challenged Nader's nominating petitions, arguing that Nader's supporters submitted voter signatures that failed to meet legal requirements.

The court's review has taken so long, more than two weeks, that several Pennsylvania counties already have mailed out absentee ballots that include Nader's name.
