Judge rejects Senate filibuster injunction

WASHINGTON, Oct. 7 (UPI) -- A federal judge in Washington Wednesday rejected a conservative group's attempt to end Democratic filibusters of President Bush's judicial nominees.

Judicial Watch, a public interest group that has filed a number of suits against government officials, argued Senate rules requiring a "supermajority" to confirm judicial nominees violates the Constitution, which merely requires the Senate's "advice and consent."

The group asked the judge to declare the Senate rules unconstitutional and to enjoin the Senate from continuing to prevent votes on two of Bush's nominees.

U.S. District Judge Colleen Kollar-Kotelly ruled Judicial Watch did not have "standing" to bring the suit -- could show no injury entitling it to be a party -- and was asking the court to violate the constitutional separation of powers.
