Colorado Supreme Court kills voucher law

WASHINGTON, June 29 (UPI) -- The Colorado Supreme Court's overturning of the state's school voucher law leaves few options for establishing such a program in the state.

The Denver Post reported Tuesday the most viable option left for proponents of the move is to persuade the legislature to redraft the law to avoid problems with the lack of control provided to local education officials.

The court ruled Monday the 2003 law unconstitutionally strips control from local school boards.

The 4-3 decision upheld a state district court ruling that local tax money cannot be used to fund private school education and is a blow for school voucher advocates hoping to gain ground in the state.

The prospect for changing the law legislatively remain uncertain given the November election, with all the seats in the state House and half in the state Senate up for grabs.

The law in question would have provided up to $5,000 in tuition vouchers to poor students in 11 underperforming school districts and was scheduled to begin in the fall.
