Court lets Scalia decide withdrawal

WASHINGTON, March 1 (UPI) -- The U.S. Supreme Court said Monday Justice Antonin Scalia would decide whether to withdraw from a case involving Vice President Dick Cheney.

Two groups are trying to get Cheney to release the records of the national energy policy group.

Scalia went on a hunting trip with Cheney one month after the Supreme Court agreed to hear the case.

One of the challenging groups, the Sierra Club, filed a "motion for recusal" earlier this month, asking the Supreme Court to vote on Scalia's withdrawal.

But the justices said in an order Monday, "In accordance with its historic practice, the court refers the motion to recuse in this case to Justice Scalia."

That means Scalia will treat the motion as a "suggestion for recusal" and decide on his own whether to withdraw.

Scalia has already indicated several times he will stay in the case.
