Jury deliberates sentence for Sikh killer

MESA, Ariz., Oct. 8 (UPI) -- A Mesa, Ariz., jury will continue deliberations Thursday, deciding whether a man should die for killing an Indian immigrant days after the Sept. 11 attacks.

The Press Trust of India said the same jury had already rejected an insanity defense and convicted Frank Silva Roque of murder.

During Wednesday's testimony, a psychiatrist said Roque suffered post-traumatic stress after the terrorist strikes and was not responsible for killing Balbir Singh Sodhi.

Defense testimony indicated Roque mistook Sodhi for an Arab because of his flowing beard and turban. He later shot at a gas station staffed by a Lebanese clerk and at the house of an Afghan family. There were no injuries in the later shootings.

Dr. Jack Potts told the court the "horrific events" would not have occurred had there been no Sept. 11. But prosecutors said Sodhi was killed out of "hatred" and "anger."
