FCC to ignore court, enforce do-not-call

WASHINGTON, Sept. 29 (UPI) -- The Federal Communications Commission says it will enforce the nationwide do-not-call list, despite a court ruling the list is unconstitutional.

In a statement, FCC Chairman Michael Powell said: "The FCC will enforce its do-not-call rules against telemarketers that have obtained the do-not-call list from the (Federal Trade Commission) beginning Wednesday. The FCC rules complement and expand on those of the FTC."

Powell said the FCC's rules were not affected by recent court cases and the commission intends to continue to "administer and enforce its rules to the fullest extent possible as the litigation proceeds."

He added the FCC is "determined to defend the choices of the American people."

A federal judge last week ruled the list violates the Constitution's free speech provisions by allowing calls from political and charitable groups, while prohibiting calls from commercial enterprises.
