Court to hear appeal on Marlins stadium

MIAMI, Sept. 1 (UPI) -- An appellate court was set Tuesday to hear arguments from an auto dealer seeking to halt the construction of the new Florida Marlins' stadium, officials said.

Norman Braman, who was stymied last year in his legal battle to force a referendum on the building of the $609 million ballpark and parking structure, was to argue his case before the state of Florida's Third District Court of Appeal in Miami, The Miami Herald reported.

Braman's argument that a public vote was necessary to approve the use of $50 million in bond referendum money for the project was defeated in court by the county, city and the baseball team, the newspaper said.

The three-judge panel was set to meet Tuesday at Florida International University to hear arguments, the Herald said.
