The niece of Vice President Joe Biden, 26-year-old Caroline Biden, will not end up behind bars after working out a plea deal following her alleged attack of a Manhattan cop earlier this year.

The details of the deal have not been made public, but Caroline was excused from her scheduled Tuesday appearance at Manhattan Criminal Court so that the terms could be finalized.

According to her attorney, Ira London, Biden will voluntarily enter a "treatment program" and her punishment will "involve no term of incarceration."

Biden was charged with obstruction of government administration, resisting arrest and harassment after she allegedly attacked a police officer who responded to an incident between herself and her roommate at their Tribeca apartment back in September.

"I know my rights, I shouldn't be handcuffed," Caroline allegedly shouted at the officer.

The misdemeanor charges could have landed her up to a year in jail and she is due back in court in early February.
