Judge tosses prostitution refund suit

NEW YORK, Feb. 8 (UPI) -- A federal judge in New York tossed a lawsuit alleging a stripper who performed sex acts in a tourist's Las Vegas hotel room did not fulfill her obligations.

Loretta Preska, chief U.S. District judge for the Southern District of New York, dismissed the lawsuit filed by Hubert Blackman, who claimed the Las Vegas Executive Personals dancer he summoned to his room left a half hour early, the Las Vegas Sun reported Tuesday.

"Plaintiff's claims do not arise under a federal statute or the U.S. Constitution," Preska wrote in the ruling.

Blackman also claimed he was traumatized when Las Vegas police threatened to arrest him when he called to report the incident and stated he wanted a $120 refund.

Preska said Blackman should have filed the suit in Nevada, "where a substantial part of the events or omissions giving rise to the claim occurred."

The judge said she decided not to transfer the suit because it "would not be in the interest of justice."
